Terms of service

Article 1 (Application)

These terms (the "Terms") govern the conditions of use of "Winenes" (the "Service"), a wine management and sales-support service provided by Winenes ("we", "our", "us"). Registered users ("Users") shall use the Service in accordance with these Terms.

Article 2 (Registration)

  1. Registration is completed when an applicant accepts these Terms, applies in the manner specified by us, and we approve the application.
  2. We may decline an application for the following reasons, and shall have no obligation to disclose the reason.
    • False information was provided in the application
    • The applicant has previously violated these Terms
    • We otherwise judge the registration to be inappropriate

Article 3 (User ID and password management)

  1. Users shall properly manage their User ID and password for the Service at their own responsibility.
  2. Users may not transfer, lend, or share their User ID and password with any third party under any circumstances.
  3. Where login occurs with a combination of User ID and password matching the registered information, such use is deemed to be by the registered User.

Article 4 (Prohibited conduct)

Users shall not engage in any of the following in connection with the Service.

  • Conduct that violates laws or public order and morals
  • Conduct related to criminal activity
  • Conduct that destroys or interferes with the function of our servers, networks, or those of other Users or third parties
  • Conduct that may interfere with the operation of the Service
  • Conduct that collects or stores personal information about other Users
  • Unauthorized access or attempts at unauthorized access
  • Impersonating another User
  • Conduct that directly or indirectly provides benefits to antisocial forces in connection with the Service
  • Other conduct we deem inappropriate

Article 5 (Suspension of service)

We may suspend or interrupt all or part of the Service without prior notice in any of the following cases.

  • Maintenance or updates to the systems supporting the Service
  • Force majeure such as earthquake, lightning, fire, power outage, or natural disaster making provision of the Service difficult
  • Failure of computers or communication lines due to accident
  • Other cases where we judge it difficult to provide the Service

Article 6 (Copyright)

  1. Users may use the Service only with respect to text, images, and other materials for which they own the necessary intellectual property rights or have obtained the necessary permissions from rights holders.
  2. Copyright in AI-generated content produced via the Service belongs to us or the User, and the User may use such content within the scope of the Service.

Article 7 (Disclaimer)

  1. We make no express or implied warranty that the Service is free of defects in fact or in law (including defects in safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, errors and bugs, and infringement of rights).
  2. Except in cases of our willful misconduct or gross negligence, we are not liable for any damage arising to a User in connection with the Service.
  3. AI analyses and wine recommendations are for reference only; the final decision is the User's own responsibility.

Article 8 (Service changes)

We may change, add to, or discontinue the contents of the Service with prior notice to Users, and Users agree to such changes.

Article 9 (Changes to the terms)

We may change these Terms at any time without notice to Users when we judge it necessary. If a User begins to use the Service after a change, they are deemed to have agreed to the revised Terms.

Article 10 (Governing law and jurisdiction)

  1. These Terms shall be interpreted under the laws of Japan.
  2. Disputes relating to the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over our head office.
